Your telegram No. 1486 [of October 31st - extraterritori- ality].

As regards Article 6 of draft treaty Government of India have asked for explicit reservations on right of travel, residence and trade in special areas both in times of (a) peace

and (b) war. In the case of (a) these apply equally to foreigners and British subjects and in the case of (b) as regards travel and residence to aliens only. The war-time restrictions are particularly important in India because of the danger of infiltration by Japanese agents.

2. While His Majesty's Government in United Kingdom would for their part have been prepared to regard these two points as something that might be regarded as going without saying, if the above reservations were made on behalf of India alone, there would be the implication that they did not go without saying. We consider therefore that it is necessary to cover the position for all the territories concerned in an agreed minute. My immediately following telegram gives a suitable text which at the appropriate moment you should ask the Chinese to accept.

3. You should if possible avoid mention of Eire, but if the Chinese press the point you should again refer to ne.

4. It now appears probable that New Zealand and South Africa will wish to negotiate separate treaties.

5. Government of India wish Richardson to sign treaty for India and I shall send you a full power for him.

6. You will receive separate instructions regarding questions of personal status and inland and coastal navigation.
